I hadn’t really paid a ton of attention to the Amanda Knox case from Italy until I read this recent piece evaluating it. Didn’t think there was anything particularly special about an American accused of a crime in another country; if she did the crime, she should answer to that country’s justice system and I just kind of figured that Italy would have a system similar to that of the rest of Europe with adequate safeguards of due process along the way. What I hadn’t really considered was that even a good justice system is still no better than the people who staff it and Italy (no surprise!) is vulnerable to more irrationalities than seems reasonable.
Granted that some of the stuff about the prosecutor’s missteps in the past are not directly relevant to the Knox case. Sarah’s assessment of the evidence in the Knox case is so plainly-delivered and clearly exculpatory that it makes you wonder what in the hell her defense attorney was doing during the trial, because it seems impossible to consider the argument without seeing at least a reasonable doubt. This is a really good example of what a good criminal defense attorney brings to the table in terms of the pursuit of justice — clear, direct, persuasive, succinct, and aimed at the truth. It’s also more than a little bit scary to think that someone lost her liberty in light of all this, and scarier to contemplate that the kind of nonsense described as going on in Italy is hardly unique to that nation — there’s plenty of that sort of weed growing here in our own local gardens of justice.
The evidence against Amanda Knox and Raffaele Sollecito is overwhelming. They gave completely different accounts of where they were, who they were with and what they were doing on the night of the murder. Neither Knox nor Sollecito have credible alibis despite three attempts each. All the other people who were questioned had one credible alibi that could be verified. Innocent people don’t give multiple conflicting alibis and lie repeatedly to the police.
The DNA didn’t miraculously deposit itself in the most incriminating of places.
An abundant amount of Raffaele Sollecito’s DNA was found on Meredith’s bra clasp. His DNA was identified by two separate DNA tests. Of the 17 loci tested in the sample, Sollecito’s profile matched 17 out of 17.
According to Sollecito’s forensic expert, Professor Vinci, Knox’s DNA was on Meredith’s bra.
Amanda Knox’s DNA was found on the handle of the double DNA knife and a number of independent forensic experts – Dr. Patrizia Stefanoni, Dr. Renato Biondo and Professor Francesca Torricelli – categorically stated that Meredith’s DNA was on the blade. Sollecito knew that Meredith’s DNA was on the blade which is why he twice lied about accidentally pricking her hand whilst cooking.
There were five instances of Knox’s DNA mixed with Meredith’s blood in three different locations in the cottage.
Knox tracked Meredith’s blood into the bathroom, the hallway, her room and Filomena’s room, where the break-in was staged. Knox’s DNA and Meredith’s blood was found mixed together in Filomena’s room, in a bare bloody footprint in the hallway and in three places in the bathroom.
Rudy Guede’s bloody footprints led straight out of Meredith’s room and out of the house. This means that he didn’t stage the break-in in Filomena’s room or go into the blood-spattered bathroom after Meredith had been stabbed.
The bloody footprint on the blue bathmat in the bathroom matched the precise characteristics of Sollecito’s foot, but couldn’t possibly belong to Guede. Knox’s and Sollecito’s bare bloody footprints were revealed by luminol in the hallway.
It’s not a coincidence that the three people – Knox, Sollecito and Guede – who kept telling the police a pack of lies are all implicated by the DNA and forensic evidence.
Amanda Knox voluntarily admitted that she was involved in Meredith’s murder in her handwritten note to the police on 6 November 2007. After she was informed that Sollecito was no longer providing her with an alibi, she stated on at least four separate occasions that she was at the cottage when Meredith was killed. At the trial, Sollecito refused to corroborate Knox’s alibi that she was at his apartment.
Knox accused an innocent man, Diya Lumumba, of murdering Meredith despite the fact she knew he was completely innocent. She didn’t recant her false and malicious allegation against Lumumba the whole time he was in prison. She admitted that it was her fault that Lumumba was in prison in an intercepted conversation with her mother on 10 November 2007.

My question reading the Monster of Florence case was what on earth were the defense attorneys of the 3 men convicted in connection with those murders doing? It’s so plain and obvious that those 3 men were not guilty of murder, but somehow the crazy Italian system just seems to get swept up into this frenzy. I hate to excoriate the defense attorneys too much, though. How much were American defense attorneys able to do in the McMartin day care case?

Like you, I didn’t pay much attention to the Knox trial when it was going on. After the conviction I spent a great deal of time getting to the bottom of things.
This is a very rare case. You will never see so clear and example of someone having been framed. I say that knowing it sounds like hyperbole, but the simply fact is the entire prosecution case is a fraud and a hoax. Not a single element of it survives scrutiny. In effect, every single prosecution claim has been convincingly refuted. The defense proved Knox’s innocence beyond the shadow of a doubt.
So why isn’t this more apparent? In good measure because the press coverage, especially by British sources, was absolutely atrocious and amounted to little more than taking dictation from the police and prosecutor. Prejudicial leaks were more prevalent in this case than any I have ever seen. The prosecution also stage managed things beautifully, concluding its presentation each day in time for the press members to have their lunches and file their stories. When the defense put on its case in the heat of the afternoon they often found that jurors were sleeping, the judge was on his cell phone, and almost no one from the press was there. Most of the reporters there simply assumed Knox was guilty and that her lawyers were telling predictable falsehoods. They certainly showed no inclination to do the kind of rigorous analysis that inevitably reveals that on logical and scientific grounds it was inevitably the defense, not the prosecution, that was telling the truth.
There are other things to consider:
–While there is no evidence against Amanda Knox and Raffaele, there is abundant and unassailable evidence against the real killer, Rudy Guede. This is not at all a “complex” case. It is simple and common. A break-in and robbery turned tragically to sexual assault and murder.
–From the time of the murder to the time Amanda Knox’s arrest she spent over 50 hours being interrogated by the police, culminating in a brutal overnight session. Not once was she allowed a lawyer. After she was arrested she was kept for three days incommunicado. She never met a lawyer until she got to court to see if she would be held for up to a year while the investigation continued.
–After her arrest, the police declared the case “closed” and threw themselves the equivalent of a ticker tape parade in their own honor (there is video). Despite the fact that Knox would not be formally charged for almost a year they stuck her portrait up on the police “wall of shame” along with convicted Mafia chieftains.
–The prosecutor in this case has already been convicted of serious abuse of office for activities in another case. Under the vagaries of the Italian system he is still allowed to persecute people and he has. Amanda Knox faces an additional six years in prison because she testified in court that she was lightly cuffed (not beaten) on the back of the head as the police tried to scare and intimidate her. Her parents face charges for having said in an interview that they believe her. Her lawyer and her co-defendant’s lawyer face charges for statements they made. Members of the press who have dared to criticize the process have been harassed and attacked to the extent that the prestigious Committee to Protect Journalists (CPJ) has written a powerfully worded protest to the President of Italy.
–While there are things to admire in the Italian approach to justice, there is dark side too that allows for convictions in cases where an indictment would not be possible in the U.S. and U.K. The rate of wrongful convictions there is appallingly high–largely because: a) judges frequently act more like members of the prosecution team rather than independent, neutral jurists; and b) there are no standards for evaluating evidence–the truth is whatever the presiding judge, in his subjectivity, wants it to be.
In going through the comments on this post, I’ve found two rather substantial comments from Domenico Grilli somehow went missing. I reproduce them here without offering any endorsement for or against their content. Rather, I reproduce them because they raise points that contribute to the discussion and put rebutal comments by Quentin Z. in context.
Also, in reviewing to find out what happened to those comments, I found that another substantial comment by Harry Rag got caught in the spam filter, from which I have freed it, again with no endorsement for or against its content.

Domenico, yours is a grotesque misrepresentation of the truth. All of her letters read in their entirety make it clear that she believed the statements she had made during the illegal interrogation were false. She didn’t let Lumumba rot in jail. The police did that. Amanda could not tell them Lumumba was innocent because she did not know that he was–the police told her they had hard evidence against him. She told the police they should not rely on her word in accusing him–and that is all she could do. Further, a number of reliable witnesses had already told the police that Lumumba was innocent but they chose not to believe them.
As for the case being simple, you are right. Guede did it. Here is the evidence:
– Bloody fingerprints on a pillow found under Meredith
– DNA inside Meredith’s body
– DNA on two articles of Meredith’s clothing (bra and fleece jacket)
– DNA on Meredith’s purse
– Bloody shoe prints
Guede confessed to being there and at trial stipulated to the accuracy of the above.
On the other hand, there is not a single bit of evidence against Amanda and Raffaele that survives analysis. Not a bit.

As for the alibi’s … The fact that the police destroyed RS alibi (computor) is enough to put this case in question forever. And it’s nobodys fault but their own.Throw in the bra clasp that was left in the room and played with by several people and then carelessly left to rust. The DNA didnt fly on it. It was put on it the same way several other peoples DNA was found to be on it who the police did not test to say who all those people were.So however the police transferred their DNA onto it is the same way Raffeals got there. I’ll bet the investigators touching the door nob to the room probably also got the the other boyfreinds DNA on it as well as RS seeing how they all claim to have tried to open the door.
Conflicting alibi’s … Everyone knows the old fashion police trick… “Hey your buddy’s telling us everything in there.” Innocent or not if you think the other persons gonna try to save themselves and pin it on you , your gonna try to save yourself. If the police didn’t lie to them then they wouldnt have felt the need to change a piece of their story to counter what they’re being told. Same goes for Raffeal’s story on pricking Merideth with the knife. Raffeal , when told there’s evidence against him seems willing to change his story from the truth and let Amanda deal with it. The mixed DNA in the foot prints … Hello, she lives there? The other girls DNA is in the house to! The foot print on the bathmat is probably from Rudy who took his shoes off when he realized he was tracking blood . Having seen the pictures i dont see how you can say who it belongs to. It’s on a rug . No shoe emblem or fingerprint etc. Its just a smudged foot print.

Another thought ! When Rudy raped Merideth, he probably took his shoes off to get his pants off therefore the other footprints are his. There is no proof saying who’s footprints any of those are (except Rudy’s). Only suggestions by my Mingini.

However it seems that every single item listed as evidence ,the defense is having to prove they did not do it. All Mingini has to do is suggest it. He has not proven anything !After years of trying this case he just adds something to it every week for the defense to have to PROVE they didnt do it. No wonder the Jurors fell asleep.
GreyFox, you hit the nail on the head. To an extraordinary degree the police and prosecutor have followed a strategy that avoids testability and objectivity. They are essentially saying KNOX AND SOLLECITO ARE GUILTY BECAUSE WE SAY SO.
You want to retest the clasp? Sorry, we destroyed the evidence.
You want to retest the knife DNA? Sorry, we didn’t do the amplification procedure correctly and the sample is tested out of existence.
You want to understand the parameters of our DNA analysis? Sorry, you can’t have the files.
You want to re-examine computers? Sorry, we overrode files and destroyed hard drives.
You want to see the CCTV images from the camera near Raffaele’s apartment. Sorry, we did not think to check them soon enough.
You want to see the recording of the Knox and Sollecito interrogations? Sorry we “forgot” to do so in both cases even though the modern police station is set up to record, it is standard operating procedure in Italy, and it is required by law.
I could go on ad nauseum. The entire case is like this.

I understand your frustration–the comment was out of line. But Harry Rag does tend to do that to people. If you were to Google him you would see that he has cut and pasted essentially the same rant maybe 1,000 times. Any time the Knox case comes up on any blog he barges in. Just about everything he says is false or misleading. I will give you one example. The so-called “bloody foot prints in the hall” is a classic. First of all, we do not know whose footprints showed up in luminol. The impressions are smudged, there are serious questions about how they were measured, and the police never took reference samples from the two other women living in the house. So all that could be said is that they may or may not have been made by Amanda Knox.
More importantly, the forensic evidence shows very clearly that they were not made in blood. The Polizia Scientifica apparently uses a protocol similar to the FBI’s field protocol. You test first with luminol, a preliminary test which will react to blood and many other household substances. They got a great many luminol hits many of which were clearly false positives. But the footprints were of interest so they then subjected to a second test with TMB and this was negative. A true confirming test would have to be done in a lab but under FBI protocol if a TMB test does not confirm the luminol finding, you are not dealing with blood. The reason is simple. While TMB produces false positives it never produces false nagatives. If blood is there it will find it.
The Italian forensic people knew this–that is why they never performed a true confirming test in a lab. Instead they tried to insinuate that the prints had to be in blood even though every test and protocol indicated this was not the case. Among other things they tried to perpetuate a hoax in another area by testing for DNA too. And that was negative too. Have you ever heard of fresh blood not producing DNA?
To summarize: We don’t whose prints those were, but the preliminary test suggesting the possible presence of blood was not confirmed by more reliable tests.
So how can Harry Rag and the sentencing judge maintain these were “bloody foot prints?” Don’t ask. The answer is too intellectually embarrassing and would take me several more paragraphs to explain.
The larger point is that every single key point of evidence is susceptible to similar refutation. The defense didn’t just raise doubts about the prosecution case–it obliterated it. Knox and Sollecito proved their innocence beyond a shadow of a doubt. Thankfully, it seems that the head judge in the appeals is fair and independent. I don’t view an over turn of the conviction as inevitable, but I do think it is likely.
Ten years from now no one will seriously argue that Knox and Sollecito were guilty. It will be widely acknowledged that Knox no more killed Merdith Kercher than Barack Obama did. All of the debate will be over the cultural blinders that prevented us from seeing what was obvious sooner. Why could we not see sooner that the emperor had no clothes?
One more thing. I agree with your wish for civility. If I am not mistaken “Domenico” called a respected Unites States Senator a “whore” and was unrebuked. That seems a tad harsher than the epithet used to describe Harry Rag.
This case has reached the point of no return, with one side accusing, the other denying everything. And each side spinning or lying about every single fact.
If we want to have a useful discussion we must start from incontrover-tible facts that cannot be denied by either side, then proceed logically from there.

Domenico you are not very convincing. Whether or not Italian law was adhered to is very much up for examination. Both the Knox and the Sollecito appeals document numerous ways in which the defense believes Italian law was not followed or was misapplied.
I vigorously dispute your final assumption–that there was more than one assassin. There is no evidence of this at all and it the assumption is falsified utterly by a close analysis of the crime scene. The defense was much more convincing on this point.
Let me also say, that while there are aspects of Italian practice that make personally very uncomfortable, there are things I admire too. You do not have a death penalty. You do not try children as adults–an abominable practice my country should dispense with. There is an element of forgiveness in Italian law and a belief in rehabilitation that we could learn from.
You also have a robust right of appeal and I believe your system will get it right this time and that Knox and Sollecito will be exonerated.
One more thing. Please do not defend Mignini. His behavior would be disgraceful anywhere in the world. The man is a menace. I have just read his interview with Bob Graham in it’s entirety. It took place over two and one half hours and is appalling. The man is stuck somewhere in the dark ages.

It is a sad and bitter world where the likes of Harry Rag aka The Machine aka Sailor are allowed to post their vile bile on blogs and articles all over the Internet. Most people acquainted with the FACTS know full well that most of his/it’s hate-filled rants have no substance whatsoever and are full of lies and misinformation.
The PMFkrs are a well-known bunch of deluded nonentities who spend hours and hours EVERY single day on their disgusting site, posting rude, crude insults about Amanda Knox and her family.
I shudder to think that I breathe in the same air as these pathetic miscreants. Would that these imbeciles crawled back under the rocks from whence they came!
AGAIN, MY CARTESIAN POSTULATES FOR A USEFUL DISCUSSION:
1) . Only Italian or European Union laws are valid in Italy.
This point eliminates from the discussion the infinity
of totally useless comments about composition and segregation of juries, functions of judges, and one and all procedural differences with U.S. law. You are in Italy, respect and obey Italian law, by golly.
And, yes, we have Habeas Corpus! And accused are innocent until proven guilty, like over most of the world!
2) . The trial was conducted fairly according to Italian law.
Probably someone will debate these point. I will happy to discuss themLi, but I want to remind all that the Defense has never accused anyone saying that the trial was unfair and that “Amanda was railroaded”.
Clearing these 2 points will eliminate a lot of useless stuff, and facilitate reaching reasonable conclusions.

Don’t forget, Domenico, Italy closely allied itself to Hitler and was invaded by the free world to liberate Italians from their own dictator. 1.) This is not about what country your’e from. It is about Justice for all ! Locking up innocent people is wrong no matter what. The Nazi’s had their laws too and it didn’t favor the Jews.Were the Jews at fault?(No offense meant) I think not !We all had slavery at one time or another . No country is without sin.
