I had been expecting the medical marijuana case this term, Raich v. Gonzalez, to be the biggest Supreme Court case of the year. It turns out that another one, Kelo v. City of New London, will probably be the real humdinger. The result sounds absolutely outrageous — a local government can condemn private property, then turn that property over to a private entity that develops and sells that property for a profit. The redevelopment is “public purpose” enough, according to the Court’s majority. Terrible, terrible stuff.
I’ll blog more about it when I have a chance to read the opinion; I can’t wait to see which Justices voted for and against this result.
